UK CUSTOMER SUBSCRIPTION PROGRAM TERMS

Under your subscription contract the products selected by you will be automatically supplied to you each month, and you will be liable to pay for those products each month, on an automatically recurring monthly basis which will continue for an indefinite period, unless and until your contract is terminated.

Your subscription includes an initial reduced cost period: for the first month (i.e. for your first order) you will receive 50% off the price of your products; from the second month onwards (i.e. for all orders after your first order) you will pay the full price of your products unless you end your contract before that time.

There is no minimum amount that you are liable to pay each month. The amount that you pay is calculated each month based on the price (including VAT) of the products selected by you. You do not pay any shipping costs for us to deliver your products to you. We may alter the prices of the products for which you have subscribed from time to time. We will inform you of this at least 30 days before the change takes effect. You will have the opportunity to cancel the subscription before the price change occurs. The product price that you will pay is the price provided to you at the time of your subscription, and the total purchase price of your products will be shown in your first order email. We may not alter the frequency of our product deliveries to you or the frequency of your payments to us.

Your delivery address and billing address must both be in the United Kingdom. Payment is to be made by debit or credit card (Visa, MasterCard, American Express, or Discover) or by Paypal.

You have an initial right to cancel your contract at any time during the period beginning on the date of our email confirmation of your subscription which we will provide together with a copy of your subscription contract until the expiry of 14 days after the delivery to you of your first purchase of products. You also have the right to cancel your contract within the first 14 days after the delivery to you of your first purchase of products at the full price. Customers will be responsible for return shipping. After the item is received by our warehouse, we will proceed with your refund. You may also terminate your contract at any time without incurring any penalty. This will bring your contract to an end and will stop it from automatically renewing. There is no minimum time period before you can exercise this right to terminate your contract and bring it to an end. Our products are children’s vitamins and supplements. Individual product descriptions are set out on our website. We may change the composition, characteristics, or selection of the products offered for sale on our website and their presentation or packaging, but any such changes will not apply retrospectively to orders submitted prior to their introduction. The images of products on our website are for illustrative purposes only: the shape, colour and size of the products delivered to you may vary from the examples shown on our website and such variations do not constitute a product defect.

We will seek to deliver the products you have ordered each month within our stated target delivery dates all of which are less than 30 days from order. We hold stocks to meet reasonably anticipated demand, but all orders are subject to availability and we reserve the right to cancel orders for any products which cease to be available for any reason.

Delivery is made and risk is transferred to you upon the physical delivery of the product to you.

You may cancel an individual monthly product order at any time before shipment and, if you have already paid for that order, Hiya will provide a refund to you of the price paid by you for that order upon receiving the product back from the customer. You will also have an opportunity to examine the products ordered after delivery and if for any reason you are not satisfied with the products for any reason then you may give notice to Hiya within 14 days of the delivery of the products that you wish to cancel that order and then, provided that you return the products to Hiya at: The Hut - Omega GB Omega South Skyline Drive, Great Sankey Warrington Cheshire WA5 3TP (or provide evidence that you have done so) within 14 days from the date of your cancellation notice, Hiya will provide a refund to you of the price paid by you for that order as soon as possible. You will not incur any charges for that refund and the same means of payment will be used as the Member used for payment.

You will receive emailed shipment notices that will include your sales receipt which will include a notice of your rights to cancel your subscription. You can use the notice of cancellation provided on the sales receipt or you can give notice in some other way (e.g. by letter, email, or telephone) as long as Hiya receives a clear statement of your decision to cancel. Please email any notice of cancellation to supportUK@hiyahealth.com.

If you reject the products after delivery to you for any reason other than damage to or a defect in the products, you must pay the cost of returning the products to Hiya and you will be responsible for their safe return. If you do not return the products to us, Hiya will be entitled to deduct the cost of recovering the products from the amount to be refunded. If you reject the products because they are damaged or faulty, Hiya will cover the cost of the return of the products by you to us.

If the products are returned by you for any reason other than damage to or a defect in the products and the products have suffered any reduction in their value as a result of handling beyond what is necessary to establish the nature, characteristics and functioning of the products then you will be charged for that diminution in value and that charge will be deducted from the amount of the refund. If products which are delivered sealed for health protection or hygiene purposes are returned unsealed after delivery then the amount of any refund will be reduced by the contract price of those products.

It is our responsibility to supply goods to you that are of satisfactory quality, conform with these contract terms, and meet your consumer rights, and if you have any concerns that we have not met our legal obligations please contact us.

If you wish to cancel your subscription contract with Hiya you may do so at any time and without incurring any penalty. In order to cancel your subscription and end your contract you can email us at supportUK@hiyahealth.com or cancel your subscription in your online account. You do not have to use any specific form of notice to cancel your contract and you need only provide us with a clear statement in some form of your decision to end the contract. If you give us notice of cancellation then your cancellation is effective from when that notice is given and we will acknowledge that you have ended your contract within 24 hours of receiving your notice.

If you cancel your subscription contract and you have already paid for an order which has not yet been shipped to you, Hiya will provide a refund to you of the price paid by you for that order. If you cancel your subscription contract and you wish to obtain a refund for products delivered to you within the 14 days period prior to your cancellation then, unless you have ended the contract because of our breach of contract, you must pay the cost of returning the products to Hiya and you will be responsible for their safe return. Hiya will provide a refund to you of the price paid by you for that order, but if you do not return the products to us, Hiya will be entitled to collect the products from you and, unless you have ended the contract because of our breach of contract, deduct the cost of recovering the products from any amount to be refunded to you.

SUBSCRIPTION PROCESS, RENEWAL, CANCELLATION, SHIPPING, BILLING & REFUNDS
18. When you purchase a subscription to Hiya through our site, you will receive an initial package with your refillable bottle or canister including your thirty (30) day supply of the vitamin supplements for which you have subscribed, then every thirty (30) days, we will send you a shipment containing a thirty (30) day supply of your subscribed supplements from us. Your subscription renews every thirty (30) days so we make sure that you do not run out of your vitamin supplements at the end of each month.
19. Your subscription will continue, and you will be charged, every thirty (30) days, until you choose to cancel. There is no subscription fee associated with your subscription. You will only be charged for the cost of the product. After your initial thirty (30) day subscription period, and again after any subsequent subscription period, your subscription will automatically commence on the first day following the end of such period (each a "Renewal Commencement Date") and continue for an additional thirty (30) day period, at your subscription price. You agree that your account will be subject to this automatic renewal feature unless you cancel your subscription at any time prior to the Renewal Commencement Date by emailing us at supportUK@hiyahealth.com or by canceling your subscription in your online account. Your order confirmation emails have links to your order. You can manage your subscription from there.
20. By subscribing, you authorize us to charge your payment provider now, and again at the beginning of any subsequent subscription period. If you choose to cancel your subscription at any time, your subscription will terminate automatically and we will not charge your payment provider for the subsequent subscription period. You agree that we may either terminate or suspend your subscription for any reason at any time at our sole discretion.
21. We will use best efforts to send your product within 3-5 business days of ordering using shipping services such as Royal Mail, Evri, Relay, DPD or DHL yet may take longer due to unforeseen delays.
22. VAT inclusive, if your payment method is declined, we will attempt to process your charge until the transaction is approved. If we are unable to complete the transaction, we may contact you directly to update your account information.
23. We use a third-party service provider for payment services (e.g., credit card transaction processing, merchant settlement, and related services). You hereby consent to provide and authorize Hiya Health Products LLC and its third-party service provider to share any information and payment instructions you provide to the extent required to complete payment transactions in accordance with this Agreement, including personal, financial, credit card payment, and transaction information. Upon initial registration of your credit card, you may see a pending charge as part of the authorization confirmation process. This is not a charge and is used to confirm account authenticity. The pending charge should automatically clear on its own. If you have any issues, please contact supportUK@hiyahealth.com.
24. We are not responsible for any fees or charges that your bank or credit card issuer may apply.
