OFFICIAL GIVEAWAY RULES

1. No Purchase Necessary

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A purchase or payment will not increase your chances of winning. This promotion ("Giveaway") is void where prohibited by law.

2. Sponsor

This Giveaway is sponsored by Hiya Health Products LLC located at 7750 Okeechobee Blvd, Suite 4-769, West Palm Beach, FL 33411 ("Sponsor"). This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta, TikTok, or any other social media platform used to promote it.

3. Eligibility

  • Open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry.

  • Employees, officers, and directors of Sponsor, its parent, subsidiaries, and affiliated companies, and its advertising and promotion agencies, and each of their immediate family members (spouse, parent, sibling, child) and household members, are not eligible to enter or win.

  • By entering, entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all matters relating to the Giveaway.

4. Giveaway Period

Giveaway timelines are expressly outlined in the posts that promote them. Sponsor's server is the official timekeeping device for Giveaways.

5. How to Enter

During the Entry Period, follow the instructions on the qualifying social media post (each, a "Post"). A typical entry method often includes:

  • Follow @hiyahealth on Instagram

  • Like and/or comment on the designated Post as instructed

  • Tag one (1) friend in the comments (occasionally this is an optional entry step, but will be stated if so

  • Sign up for email list

Limit one (1) entry per person, per Instagram handle, per Giveaway, regardless of the number of comments, tags, or shares unless otherwise noted. Multiple entries by the same person, or entries made through the use of multiple accounts, will be disqualified. Automated entries are not permitted.

6. Winner Selection & Odds

  • Winner(s) will be selected in a random drawing from among all eligible entries received during the Entry Period.

Drawing will be conducted by Sponsor or its designated representative after the final day of the giveaway.

  • Odds of winning depend on the total number of eligible entries received.

  • Winner(s) will be notified via direct message (DM) or comment reply on the winning platform account, and/or by email if an email address is collected, within a reasonable time period. 

7. Prizes

Each Giveaway’s specific prize package (products and cash amount, if any) and number of winners will be stated in the corresponding Instagram Post and is incorporated into these Official Rules by reference. Example: "5 winners will each receive a 6-month supply of [products] and $X cash."

  • Prizes are awarded "as is" with no warranty or guarantee, either expressed or implied by Sponsor.

  • Prizes are not transferable, redeemable for cash (except the stated cash portion, if any), or substitutable, except at Sponsor's sole discretion.

  • Sponsor reserves the right to substitute a prize of equal or greater value if a stated prize becomes unavailable.

8. Winner Verification & Claim

  • Potential winner(s) must respond to the notification within [48–72] hours or the prize may be forfeited and an alternate winner selected.

  • Potential winner(s) may be required to sign and return an Affidavit of Eligibility, Liability Release, and (where lawful) a Publicity Release, and to provide a valid mailing address, within the time period stated in the notification.

  • Failure to comply with these Official Rules, or to execute and return required documents within the specified time period, may result in disqualification and selection of an alternate winner.

9. Taxes

All federal, state, and local taxes, and any other costs and expenses associated with acceptance and use of a prize not specifically stated herein, are the sole responsibility of the winner. Winners receiving a prize (cash and/or product) with a total value of $600 or more in a calendar year may be required to complete and submit an IRS Form W-9 prior to prize fulfillment, and may receive an IRS Form 1099 from Sponsor.

10. Publicity Release

Except where prohibited, acceptance of a prize constitutes permission for Sponsor to use winner's name, city/state of residence, and likeness for advertising and promotional purposes without further compensation, unless prohibited by law.

11. General Conditions & Release of Liability

  • Sponsor reserves the right to cancel, suspend, or modify this Giveaway, or any part of it, if fraud, technical failure, or any other factor beyond Sponsor's reasonable control impairs the integrity of the Giveaway, as determined by Sponsor in its sole discretion.

  • Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway, or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.

By entering, entrants agree to release and hold harmless Sponsor, its parent and affiliated companies, and each of their respective officers, directors, employees, and agents, from and against any claims, damages, losses, or liabilities arising from participation in the Giveaway or the acceptance, use, or misuse of any prize.

  • Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, or for any technical failure of any kind, including but not limited to malfunctioning of any network, hardware, or software.

12. Platform Release

Entrants acknowledge that this Giveaway is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc., Instagram, TikTok, or any other platform used in connection with the Giveaway, and each entrant fully releases each such platform from any and all liability in connection with the Giveaway.

13. State-Specific Notices & Registration

  • Residents of certain states (for example, New York and Florida) may require Sponsor to file a bond and/or registration with the applicable state authority if the total prize value across the promotion exceeds the state's statutory threshold.

  • If required by a resident state, a list of major prize winners may be obtained by sending a self-addressed stamped envelope to Sponsor's address above within [90] days of the Giveaway end date.

14. Children's Privacy

This Giveaway is intended for entry by adults (parents/guardians) only. Entry mechanics must not require or solicit any information from, or direct any call to action toward, children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). Any user-generated content submitted as part of entry (e.g., photos, comments) should not depict or identify a minor in a manner that collects personal information from that minor.

15. Disputes

This Giveaway is governed by the laws of the State of Florida, without regard to conflict of law principles. As a condition of participating, entrant agrees that any disputes will be resolved individually, without resort to any form of class action, and exclusively in the state or federal courts located in Florida.
